Terms:	All of the following terms and conditions must be adhered to and are legally binding immediately upon sign-up. Vivio Technologies reserves the right to terminate any agreement at their discretion. DO NOT SPAM IN ANY WAY It is best to avoid using any method of advertising that could even remotely be considered spam. Vivio Technologies realizes that there are legitimate businesses that advertise opportunities via email or newsletters, but spam is something that we as a company do not want to be associated with in any way. Therefore we ask that our affiliates do the same, and avoid any method of advertising that may be considered spam by some individuals. Any account accused of spamming will be terminated immediately - unless otherwise determined by Vivio Technologies. Only one account is allowed per company, individual or organization. You may use this account for as many domains and/or websites as you wish. A valid USA social security number (SSN) or Tax ID must be provided for all payments made to USA addresses. You agree to allow Vivio Technologies to check validity and cross reference your SSN or Tax ID to the "payable" name on your account. Payments will not be mailed until this requirement is properly satisfied. Pay periods run from the 1st to the end of month. Checks are mailed the last day of the following month. Minimum earnings to receive a check is $50.00. You must be the owner of any copyrighted content displayed on your site. Also, you must be the holder of any trademarked terms contained in your sites meta tags. The action of sending any hits from any URLs which contain and/or promote the following content: adult content or any type of pornography, teen model websites, non-nude teen sites, MP3s, ROMs, EMUs, newsgroup postings, spam e-mails, racism, promotion of hatred, violence or any other site which contains content or promotes activities which are illegal in the United States without the prior written consent of Vivio Technologies will result in the immediate cancellation of the account from which the hits were sent and the forfeiture of any funds owed to that account. A functional username and password must be provided for all password protected URLs of an advertiser's site which will contain the affiliate link to Vivio Technologies prior to placing our link on that page. The username & password combination must remain functional throughout the term of the advertiser's affiliate account. Failure to provide a functional username and password prior to sending traffic will result in the termination of that advertiser's account and also may result in the forfeiture of any funds owed to that account. Vivio Technologies reserves the right to terminate any account which we deem, at our sole discretion, as "idle". Vivio Technologies reserves the right to terminate the account of any affiliate who publicly posts derogatory and or slanderous statements about Vivio Technologies, its subsidiaries or officers. Vivio Technologies will vigorously defend itself against false and/or slanderous statements. All funds are paid by check in U.S. dollars only. All web pages referring to Vivio Technologies must be written in English. Each page that contains a Vivio Technologies link must be part of a regularly viewed web page that is accessed by a surfer during that surfer's visit to your website(s). If this situation is not found, your account will be terminated and any funds owed will be forfeit. Under no circumstances shall we be liable for any delay or failure in performance under these terms and conditions resulting directly or indirectly from acts of nature, forces, or causes beyond its reasonable control, including, without limitation, Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, strikes, labor disputes, riots, insurrections, civil disturbances, shortages of labor or materials, fires, flood, storms, explosions, acts of God, war, governmental actions, orders of domestic or foreign courts or tribunals, non-performance of third parties, or loss of or fluctuations in heat, light, or air conditioning. Vivio Technologies reserves the right to modify this agreement, and/or modify payout rates, at any time at our sole discretion. Changes to these terms will be posted to the Vivio Technologies web site. Non compliance with these terms and conditions will result in the forfeiture of all monies owed and the possible prosecution of the offending individual or company.
